Terms of Service

These terms govern your use of the Loamio website at loamio.com and any Loamio software product you have access to (collectively, the "service"). By using the service, you agree to these terms.

Who can use the service

The service is intended for irrigation districts, mutual ditch companies, and the people who work for them. You must be at least 18 to use it. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Your account and data

You are responsible for keeping your account credentials secure and for the activity that happens under your account. The district data you put into Loamio is yours. We hold it and process it on your behalf so the software works. We will not sell, license, or share it — see the privacy policy for the details.

Early access

Loamio is currently in early access. That means features may change, performance may vary, and we may pause or discontinue features with reasonable notice. We do not currently offer a formal uptime SLA, but we operate the service in good faith and respond to outages promptly.

Pricing and payment

Loamio uses flat annual pricing based on district size — no per-user fees and no surprise modules. Your specific price is set in a written agreement (or order form) before you start paying. Invoices are annual unless we agree otherwise in writing.

Termination

You can stop using the service at any time. If you cancel, we will export your district's data for you on request and delete it from our systems 90 days after the end of your subscription, except for backups which rotate on a 35-day cycle. We may suspend or terminate access if you materially violate these terms, after written notice and a chance to cure where reasonable.

Warranty disclaimer

The service is provided "as is" and "as available". Loamio makes no warranty that the service will be uninterrupted or error-free. We do warrant that we will use commercially reasonable care to operate the service competently and to keep your data secure.

Limitation of liability

To the maximum extent permitted by law, Loamio's total liability under these terms in any 12-month period is limited to the amount you paid Loamio in that period.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Larimer County, Colorado.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the date at the top of this page and, for current customers, send an email notice at least 30 days before the change takes effect.
